These terms and conditions are not to be considered an offer, acceptance or express guarantee of service.

3.1 Accuracy

We guarantee the accuracy of our product descriptions, prices, and stock information for both hardware and software. Please reach out to us via the email listed, in case the wrong item was sent for a replacement. We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. 

4. Orders and Payment

4.1 Payment

We facilitate secure payment processing through PayPal and accept most major credit cards. An 8% sales tax will be added to your order total. No checks or money orders. Please note that chargebacks in favor of Cyber Sunshine Labs will be subject to an additional 5% processing fee.

5. Shipping and Returns

5.1 Delivery

For digital goods, we aim to deliver within 1 hour of purchase. In some cases, such as holidays, the maximum delivery time is 24 business hours. Hardware delivery will vary.

5.2 Refunds

For digital goods, no refund will be offered. A replacement will be sent in case the incorrect item was delivered on our end. Hardware purchased through eBay is eligible for a 30-day return.

The logos displayed on our website are recognized trademarks owned by their respective companies or entities. It's important to note that the presence of these logos on our site does not imply any form of affiliation, endorsement, or partnership between Cyber Sunshine Labs and the corporations to which these trademarks belong. To report cases of copyright infringement please email Support@Cybersunshinelabs.com. Parts of this site may not be reproduced, duplicated, copied, sold, resold or exploited in it's entirety or any portion, in any way, without prior written permission from us.

7. Limitation of Liability and Dispute Resolution

Cyber Sunshine Labs, to the fullest extent permitted by applicable law, expressly disclaims any liability, including but not limited to the following:

7.1.1. Improper Installation: Cyber Sunshine Labs shall not be held liable for any consequences arising from improper installation of its products or services, and any associated issues shall not be attributed to the company.

7.1.2. Payment Issues: The company assumes no liability for payment-related issues, including but not limited to failed transactions, payment processing errors, or unauthorized transactions. Any losses or damages resulting from such issues are the responsibility of the parties involved, excluding Cyber Sunshine Labs. You also signify you are the legal owner of the credit card, payment account or funds used for purchase.

7.1.3. Hardware Issues: Cyber Sunshine Labs offers a 30-day money-back guarantee for hardware purchases. We guarantee any software or hardware to be exactly as described. For hardware, any issues within the first 30 days after purchase. Please reach out to us prior to doing so to receive an RMA number. This will guarantee your refund is processed as quickly as possible.

7.2. Dispute Resolution

7.2.1. Non-Binding Arbitration: By accepting this agreement, customers agree that, in the event of disputes or disagreements arising from transactions with Cyber Sunshine Labs, they will resolve such matters exclusively through non-binding arbitration. This arbitration process allows for an impartial assessment of the issues at hand, with the outcomes serving as non-binding recommendations rather than legally binding decisions.

7.2.2. Arbitration Process: Arbitration proceedings will be conducted in accordance with established arbitration rules and procedures. The decision of the arbitrator shall be advisory and non-binding. Parties involved explicitly agree that, by accepting this agreement, they waive the right to pursue alternative legal actions related to disputes with Cyber Sunshine Labs unless obligated by law.

By accepting this agreement, customers agree not to pursue alternative legal actions in relation to disputes with Cyber Sunshine Labs. This limitation is an essential element of these terms and conditions. The headings used in this agreement are for convenience and should not be seen to limit or otherwise affect the terms.
